This Terms & Conditions document (“Terms”) governs the use of the mobile application “Great India Game” (“GIG”), operated and owned by SFXI DIGITAL PRIVATE LIMITED, a company incorporated under the laws of India, having its registered office at HD031 WEWORK ELDECOCENTRE, SHIVALIK COLONY, Malviya Nagar, New Delhi 110017, India, bearing Company Identification Number U62099DL2024PTC439408. By accessing, installing, registering, or using GIG, you (“User”, “Player”) agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines incorporated herein by reference. If you do not agree, you must discontinue the use of the service immediately.
1. Nature of the Service
GIG is an opinion-based trivia game intended solely for entertainment and educational purposes. The platform uses virtual, non-monetary coins for in-app activities. These coins have no real-world monetary value, cannot be exchanged for cash or monetary equivalents, and do not constitute winnings in a game of chance. GIG does not offer gambling, betting, or any activity involving real money stakes.
2. Eligibility
The service is available to individuals who are at least thirteen (13) years of age. If a user is under the age of eighteen (18), the user represents and warrants that they have obtained the consent of a parent or legal guardian before registering for and using the service. Users are responsible for ensuring that their use of GIG complies with applicable laws and regulations in their jurisdiction.
3. Account Registration and Security
To access certain features, you may be required to create an account and provide accurate, complete, and up-to-date information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. SFXI DIGITAL PRIVATE LIMITED shall not be liable for any loss or damage resulting from your failure to secure your account. The company reserves the right to suspend or terminate accounts that are suspected of fraudulent, illegal, or abusive activity.
4. Game Content and Accuracy
The questions, answers, and other game content are based on sample surveys, expert opinions, publicly available data, and other third-party sources. The information provided is not guaranteed to be accurate, complete, or up-to-date and may not represent absolute facts. SFXI DIGITAL PRIVATE LIMITED does not accept any liability for reliance placed upon the game content. Users may report inaccuracies by contacting sanjana@socialeffectsindia.com or using in-app reporting tools.
5. Virtual Coins and Rewards
The Great India Game (“GIG”) is an opinion-based trivia game that uses virtual, non-monetary coins solely for participation in in-game activities and features. GIG does not offer real-money gaming, gambling, or withdrawals, and all virtual coins have no cash value and cannot be redeemed for money or monetary equivalents. Virtual coins represent a limited, revocable license to access digital features within GIG and remain the exclusive property of SFXI DIGITAL PRIVATE LIMITED at all times. Coins are non-transferable and may be forfeited if your account is terminated or suspended for any reason.
GIG may offer rewards such as deals, discount vouchers, coupons, or gift cards in association with partner brands or third-party service providers. SFXI DIGITAL PRIVATE LIMITED does not guarantee, endorse, or take responsibility for the redemption, quality, or availability of such rewards. All obligations relating to the fulfillment, validity, terms of use, and redemption of such rewards lie solely with the issuing brand or partner, and users are advised to review the applicable terms provided by such third parties before redemption.
6. Acceptable Use
Users shall not engage in cheating, hacking, use of automated scripts, or any activity intended to manipulate gameplay or gain an unfair advantage. Harassment, abuse, posting of illegal or infringing content, and disruption of service are strictly prohibited. SFXI DIGITAL PRIVATE LIMITED may employ anti-cheat measures and monitor gameplay patterns, device identifiers, and other relevant data to detect and prevent unfair play. Violation of these rules may result in account suspension, termination, or legal action.
7. Intellectual Property
All intellectual property rights in GIG, including but not limited to its software code, design, graphics, question database, user interface, trade names, trademarks, and logos, are the exclusive property of SFXI DIGITAL PRIVATE LIMITED or its licensors. No part of the application may be copied, modified, reproduced, distributed, or used to create derivative works without prior written consent.
8. Advertisements and Third-Party Services
GIG may display advertisements or provide access to third-party websites, products, or services. SFXI DIGITAL PRIVATE LIMITED is not responsible for the content, accuracy, legality, or safety of such third-party materials. Your dealings with third parties are solely between you and the respective third party.
9. Updates and Modifications
SFXI DIGITAL PRIVATE LIMITED reserves the right to modify, update, suspend, or discontinue any aspect of the service, including game mechanics, features, and coin values, at its sole discretion without prior notice. Continued use of the service following changes constitutes acceptance of the revised Terms.
10. Termination and Data Retention
SFXI DIGITAL PRIVATE LIMITED may terminate or suspend your account at any time for breach of these Terms or for any other reason deemed necessary to protect the integrity of the platform. In the event of termination, all virtual coins and progress will be forfeited without refund. The company may retain user data for a minimum of one hundred and eighty (180) days or as otherwise required under applicable Indian law.
11. Force Majeure
SFXI DIGITAL PRIVATE LIMITED shall not be held liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, internet or telecommunications outages, strikes, government actions, or cyberattacks.
12. Disclaimers and Limitation of Liability
The service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. To the fullest extent permitted by law, SFXI DIGITAL PRIVATE LIMITED disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. The company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of GIG. In no event shall the company’s aggregate liability exceed the amount paid by the user, if any, for accessing GIG in the preceding six (6) months.
13. Indemnity
You agree to indemnify, defend, and hold harmless SFXI DIGITAL PRIVATE LIMITED, its directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the service or your violation of these Terms.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising from or related to the service shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India, subject first to resolution through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and SFXI DIGITAL PRIVATE LIMITED with respect to the service and supersede all prior agreements, understandings, or representations, whether oral or written.
